Copyright
All intellectual material contained within the "Sanctum: Living" pre-designed home (as supplied in this website) and or transaction (The Plans) is protected by the Australian Copyright Act and cannot be reproduced for any other purpose other than building upon the Project Land without the written permission of Sanctum Design Consultants P/L. Any such breach of the Copyright Act shall expose The Purchaser (or other liable party) to legal action to claim any loss or damage arising from any such Copyright breach.
Restricted license
In purchasing The Plans, The Purchaser is granted a restricted license, enabling The Plans to be reproduced solely for the purpose of creating a single building only upon the nominated Project Land (as described by the purchaser). The purchase of The Plans does not entitle the purchaser or any other party to recreate a building from the design on any other allotment without the written permission of Sanctum Design Consultants P/L.
Manipulation of plans
In purchasing The Plans, permission is granted to the purchasers' "Nominated Draftsperson" to adapt the design to the Project Land for the purpose of constructing the design (as represented in The Plans) upon the Project Land. Any manipulation of The Plans does not warrant the purchaser or any other party to claim intellectual property over The Plans or its derivatives.
General disclaimer
Where the Plans have been adapted to suit the Project Land, Sanctum Design Consultants shall not be liable for the structural integrity, energy efficiency, cost of construction, construction warranty, statutory compliance or any other claim arising from the implementation of The Plans to the Project Land. The Plans form no guarantee as to compliance with the local governing law, planning controls or building and construction standards.
The Purchaser shall engage a qualified structural engineer to provide all necessary structural designs and specifications, in accordance with the governing law and or construction standard. Sanctum Design Consultants P/L shall not be liable for any structural design or defective structure or item or product arising from the use or manipulation of the Plans. The Plans shall not be used as Construction Documents.
The Plans as provided in the Purchase Documents have been specifically designed to suit a certain orientation in the Southern Hemisphere (as described in the Solar Sector Diagram) and is detailed for a temperate to warm temperate climate. To retain an energy efficient building in any other climate zone or orientation it shall be the responsibility of the Purchaser or its Nominated Draftsperson to manipulate The Plans to achieve this objective.
Glossary
The Purchaser - means any person or legal entity purchasing the plans
The Plans - means the design and supporting documents supplied in this purchase.
The Project Land - Means a single legal parcel of land as registered by the Land Titles Office (or similar Land Registration Office)
Nominated Draftsperson - Means a suitably qualified draftsperson.
Construction Documents - Means any documentation supplied (in this purchase) to be used by any person or company to build a structure as represented in The Plans, without engaging a qualified structural engineer and or licensed builder to design and/or build The Plans in accordance with the applicable national construction standards and local governing law.
